Chapter Two Major difficulties and Cause Analysis

2.1 Difficulties at Lexical Level

When it comes to legal lexicon, a distinctive feature of legal language, is the usage ofunique and recondite legal terms. It is the most visible linguistic feature of legal languageas a technical language, which is the universal feature that can apply to any legal languagesas well. For each language, however, it usually develops its own legal language withdistinguishable characteristics. It results from and reflects the law of the particular legalsystem concerned. In legal translation, there can be many lexical or terminological featuresand problems, but in this report herein, only two major features that pose difficulties to thetranslation process are considered.

2.1.1 Terms with Chinese Characteristics

The first difficult point in lexical features is the translation of culture-bound terms,namely, terms with Chinese characteristics, referring to concepts, institutions andpersonnel which are specific to the source language culture. Though not pervasive, theseterms create impediments to the translation. For example:

2.2 Difficulties at Syntactical level

At the syntactical level, two types of sentences are found to be tough issues to besolved. First, long sentences including simple long sentences, complex long sentences andenumerative long sentences demand logic combing and form unity. Second, the “de(的)”structured sentences are in want of complete semantic meaning and proper connection toother parts of the whole sentence. These two difficult points are demonstrated and analyzedbelow with examples.

2.2.1 Long Sentences

Traditionally, the pursuit for precision in legal drafting can result in cumbersomewriting, “with many long sentences collapsing under the weight of obscure qualifications”(Garner, 2001: 663). Despite this, the generous use of long sentences is still a feature inlegal languages of Chinese and English legal texts for the sake of the authority, solemnity,and generality of the law.
