As a conclusion to the project, I would like to put forth my findings:

The existing criminal justice system is based not on the concept of restitution of the victim but on deterrence. As a result of this, the victim has hardly any role in the entire process of criminal trial other than that of a victim.

The need for increasing the victim's participation in the justice system has been felt by many, in light of which, scholars have put forth various views on the changes that need to be implemented.

The Malimath Committee report puts forth many suggestions which increase the role of the victim in a criminal trial. But hardly any deal with the victim's role in filing of a police report.

The Code of Criminal Procedure (Amendment) Act, 2008 brings into force most of these changes. It particularly recognizes the special needs of women with respect to arrest and trial. Even this amendment, however, does not deal with the role of a victim in filing of a police report.

Awareness regarding need for increased participation of victims in administering of criminal justice has been felt world over, in light of which Constitutional amendments have been suggested in countries like America and the United Nations has recognized this by way of declaration.

A new beginning may be brought about by a model legislation based on the United Nations' Declaration of 1985. This legislation should include a victim compensation scheme, which the 2008 CrPC amendment already does by introduction of section 357A. It is necessary to pay due compensation to the crime victims to assure them of the care and protection of the government and society. This is because justice is a basic human rights and it is deserved by every citizen from his or her government. The need is urgent to take a fresh and new look and recognize the rights of the victims of crime in the criminal justice delivery system.
