Liability Of Internet Providers In Relation To Defamation Law essay


According to Keeton, ‘there is a great deal of the law of defamation which makes no sense’. Certainly, the validity of this statement cannot be disputed especially today, where the advent of the Internet has made it almost onerous for a balance between freedom of expression and freedom from defamation to exist. Undoubtedly, the Internet created a new reality of freedom of expression. It provides the ordinary person with limitless opportunities to express and publish his thoughts instantly throughout the globe. On the one hand it is good news that free communication has become so much easier and that the right to freedom of expression has been reinforced through the evolution and expansion of the Internet. On the other hand, however, as far as the protection of reputation is concerned, the online, boundless world, a world not so easy to regulate, is a more perilous place than ever [5] . As a result, the law of defamation as it relates to the Internet has always been a constant ground for controversy. The potential of defamatory posts or comments by Internet users in the web has created a ‘monumental headache’ [6] for the Internet Service Providers [7] , who are involved in their online distribution, since they are the first to be called for holding liability for defamation claims.


This essay, will therefore attempt to make a critique on the liability of the ISPs as it relates to defamation claims borne out of nefarious posts on the Internet. [approach]


In order to appreciate the difference of the law of defamation as it applies to the Internet, it appears essential to firstly refer to the traditional standards of defamation. In the physical world, defamation is essentially a tort and defined as “a statement that harms another’s person reputation [8] .” However, the mere making of a statement cannot give rise to a legal action; liability arises only and if publication of that statement occurs. Consequently, ‘publishers’ like newspapers, magazines and broadcasting media, which conventionally exercise editorial control over content, are normally responsible for the defamatory statements that they make [9] . However, as far as cyberspace is concerned, the answer to the question of who the publisher of a specific statement is, is not that straightforward.
