知识产权(IPR)津贴(专利,商标,版权),是由政府正式允许的,以及在某一段时间内提供给拥有者用自己的知识产权(IP)的限制的权利。知识产权保护的基础是通过给知识产权所有者恢复他们的研究和开发成本的机会,来推动创新。开发新的技术、产品、音乐和其他创造性的输出可以通过产权的授予。知识产权保护一直是限制范围或时间的保护,因为知识产权的权利排他性会阻碍所有者在他们的业务领域的发挥。每个国家的知识产权保护都不同。


知识产权保护的程度因国家而异。在发展中国家知识产权保护仍是一个问题,需要进一步的发展,因为他们没有建立知识产权政策来受到相关法律的保护。因为国际监管的存在现在确保这些国家有一个适当的知识产权保护水平。但是对发展中国家实施知识产权引发了一些争议。

Chapter 1: Introduction

Intellectual property rights (IPR) are entitlements (patent, trademark, and copyright) that are officially permitted by governments and provide to owners the restricted right to utilize their intellectual property (IP) for a certain amount of time. The basic foundation for IPR protection is to provide a motivation for innovation by giving IP owners a chance to recuperate their costs of research and development. Development of new technologies, products, music, and other creative output can be made by the granting of property rights. IPR protection is always restricted in either the scope or length of protection because exclusivity of the rights to the IP owners can hinder completion in their field of operations. IPR protection differs from country to country.

The extent of IPR protection varies from country to country. In developing countries IPR protection is still a matter that requires further development as they do not have established IPR policy that is protected by related laws. Changes in international regulation are now ensuring that these countries have an adequate level of IPR protection. However the implementation of IPR for developing countries has given rise to several controversies.

Chapter 2: Literature Review

Introduction

This chapter reviews firstly the definitions of Intellectual Property and Intellectual Property Rights. It then gives an outline of the 2 different perspective concerning Intellectual Property Rights. It continues by considering the regulations of intellectual property under the Trade Related aspects of Intellectual Property (TRIPs), followed by the World Trade Organisation (WTO) TRIPs rules and the Coverage of the TRIPs. It ends by giving an overview of the controversies over TRIPs.
 nIntellectual Property (IP)

According to the World Intellectual Property Organisation (WIPO), Intellectual property (IP) refers to creations of the mind: inventions, literary and artistic works, and symbols, names, images, and designs used in commerce. WIPO further describes that IP is divided into two categories: Industrial property, which includes inventions (patents), trademarks, industrial designs, and geographic indications of source; and Copyright, which includes literary and artistic works such as novels, poems and plays, films, musical works, artistic works such as drawings, paintings, photographs and sculptures, and architectural designs. Rights related to copyright include those of performing artists in their performances, producers of phonograms in their recordings, and those of broadcasters in their radio and television programs.
